1. Definitions & Acceptance

These Terms and Conditions govern access to and use of the website operated by DRVV Couture (OPC) Pvt. Ltd. (“the Company”, “we”, “us”, “our”). By accessing this website or submitting a request for work, you (“User”, “Customer”, “You”) agree to be bound by these Terms and the applicable laws of India. If you do not agree with any part of these Terms, you must refrain from using the website.

2. Nature of Work & Scope

The Company undertakes handcrafted, made-to-order textile and apparel works, including invitation-based custom work and associated services such as consultations, fittings, and alterations. All works are handmade, and variations in texture, finish, colour, weave, or detailing are inherent to the process and shall not be construed as defects.

3. Pricing & Quotations

Prices are not displayed on the website and are determined on a case-by-case basis depending on materials, labour, time, and scope of work. A written quotation is shared once a request or invite is accepted by the Company. Prices confirmed in writing remain fixed for the specific order.

4. Orders, Invites & Acceptance

Submission of an enquiry or request does not constitute an order or acceptance. Work commences only after written confirmation from the Company and mutual agreement on the scope and cost of work. Once a pro forma invoice is issued by the Company, it shall be construed as confirmation of an order and acceptance of the agreed scope and pricing. The amount stated in the pro forma invoice becomes due and payable upon issuance, irrespective of whether payment has been made, unless the order is cancelled within the stipulated cancellation period. The Company reserves the right to accept or decline any request at its discretion.

5. Cancellation, Returns & Refunds

An order may be cancelled within one (1) day of the customer receiving the pro forma invoice. After the expiry of this cancellation window, cancellation is not permitted and the customer remains liable to pay the agreed remuneration as per the accepted quotation, irrespective of whether work has commenced. Returns are not accepted for any custom, made-to-order, or invitation-based works. However, the Company values its relationship with customers and may, at its discretion, offer repairs, refits, or alterations within reasonable and fair-use parameters. Such accommodations do not constitute acceptance of returns or refunds. Once work has commenced, refunds are not permitted under any circumstances.

6. Payment Terms

Online payment gateways may not be enabled on the website. Payment methods, schedules, and timelines are communicated individually in writing. Failure to complete payment may result in suspension or cancellation of the order. Notwithstanding such suspension or cancellation, the customer remains liable to pay the full agreed amount as per the accepted quotation.

7. Shipping & Delivery

Shipping arrangements and delivery timelines are communicated on a per-order basis. Delivery timelines are indicative and may vary due to logistics constraints or external factors beyond the Company’s control. For international shipments, customs duties and taxes are borne by the customer. Risk of loss transfers to the customer upon delivery.

8. Intellectual Property Rights

All designs, sketches, patterns, concepts, images, text, garments, samples, and other creative works displayed on the website or created by the Company in the course of providing services are the exclusive intellectual property of the Company, unless expressly agreed otherwise in writing. No right, title, or interest in any intellectual property is transferred to the customer by virtue of an enquiry, quotation, pro forma invoice, payment, or delivery of finished work. The customer is granted only a limited, non-transferable right to use the finished product for personal purposes. Reproduction, duplication, adaptation, resale, commercial exploitation, reverse engineering, or sharing of the Company’s designs, whether in full or in part, without prior written consent is strictly prohibited. Unauthorised use may result in legal action under the Copyright Act, 1957 and the Trade Marks Act, 1999.

9. Confidentiality

All measurements, design discussions, and personal details shared by customers are treated as confidential. The Company may document completed works for archival or promotional purposes unless expressly declined by the customer in writing.

10. Limitation of Liability

The Company shall not be liable for natural variations inherent in handmade work, delays caused by third-party logistics providers, force majeure events, or any indirect or consequential damages. Any liability, if established, shall be limited to the value agreed for the specific work.

11. Force Majeure

The Company shall not be liable for any failure or delay in performance arising from events beyond its reasonable control, including natural disasters, governmental restrictions, labour disruptions, or supply chain interruptions.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. All disputes are subject to the exclusive jurisdiction of the courts of Haryana.

13. Amendments

The Company reserves the right to amend these Terms at any time. Continued use of the website following such amendments constitutes acceptance of the revised Terms.
